Binding arbitration.Except for the limited claims described below, any dispute, claim, or controversy arising out of or relating to these Terms, this website, or your interactions with DLV Financial that cannot be resolved through good-faith discussion shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Harris County, Texas, unless you and we agree otherwise in writing. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver.All disputes shall be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims, and may not preside over any form of representative or class proceeding.

Right to opt out. You may opt out of this arbitration agreement by sending written notice to DLV Financial, LLC at the address in section 11 within 30 days of the date you first agree to these Terms. Your notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

Limited exceptions.Notwithstanding the above, either party may bring an action in small-claims court for disputes within that court's jurisdiction, and either party may seek injunctive relief in court to protect its intellectual property rights or address unauthorized access to its systems.

Severability. If any portion of this arbitration provision is held to be unenforceable, the remaining portions shall remain in effect, except that if the class-action waiver is held unenforceable as to any claim, then the entire arbitration provision shall be void as to that claim only.

We may update these Terms & Important Notice from time to time. When we make material changes, we will post the updated terms on this page and update the effective date above. Your continued use of the website after we post changes constitutes your acceptance of the updated terms.
